Pre-trial custody and restrictive measures imposed on suspects in Zlatko Ibrišimović et al.

On 24 April 2024 the Court of Bosnia and Herzegovina granted the Prosecutor’s Motion dated 24 April 2024 in the case of Zlatko Ibrišimović et al., and issued a Decision remanding the suspects Adnan Smajlović, Sančez Jukić and Aida Halać in custody, which under the Decision may last for a maximum of one month running from the day of arrest, i.e. until 22 May 2024 or until the Court issues a new decision, on the specific grounds of custody referred to in Article 132(1), Subparagraphs a) and b), of the CPC BiH.

The same Decision dismissed as ill-founded the Prosecutor’s Motion of 24 April 2024 to order custody of the suspects Adnan Smajlović, Sančez Jukić, Aida Halać, on the specific grounds of custody referred to in Article 132(1)c) CPC BiH.

 

The Decision dismissed as ill-founded the Prosecutor’s Motion of 24 April 2024 to order custody of the suspects Mustafa Selmanović, Vahidin Munjić, Senad Kadić, Adin Ćatić, Emir Druškić, Sead Preljević, Davor Curl and Edin Kačar, who are hereby released.

 

The Decision dismissed as ill-founded the Prosecutor’s Motion of 24 April 2024 to order custody of the suspects Tarik Zulović, Haris Behram, Mirsad Skopak, Mak Šemšić, Elmir Sarić, Smail Šikalo and Gordan Memija, who shall be released immediately, while the following restrictive measures are hereby imposed on them:

 

  • travel ban – against the suspect Gordan Memija;
  • ban on meeting with specific individuals – against the suspects Tarik Zulović, Haris Behram, Mirsad Skopak, Mak Šemšić, Elmir Sarić, Smail Šikalo and Gordan Memija.

 

The imposed restrictive measures may last for as long as necessary, and their justifiability shall be checked on a bimonthly basis.

 

Pursuant to Article 126.b)(3) CPC BiH, the suspects Tarik Zulović, Haris Behram, Mirsad Skopak, Mak Šemšić, Elmir Sarić, Smail Šikalo and Gordan Memija are particularly warned that they may be remanded in custody if they fail to abide by the measures imposed by the present Decision.

 

An appeal from the Decision shall not stay its execution.

 

The foregoing persons are suspected of the criminal offenses of Organized Crime under Article 250 of the Criminal Code of Bosnia and Herzegovina and Money Laundering under Article 209 CC BiH.
