Suspects in Zlatan Ćuk et al. ordered in custody

In the case of Zlatan Ćuk et al. (S1 2 K 044650 22 Krn), ruling on the Motion filed by the Prosecutor's Office of Bosnia and Herzegovina on 28 December 2022 to order custody of the suspects Boško Ćuk, Željko Simić, Savo Nešković, Radan Dotlić and Dalibor Simić, having held a public hearing to consider the Prosecutor’s Motion, on 28 December 2022 the Court of Bosnia and Herzegovina issued a Decision ordering the suspects Boško Ćuk, Željko Simić, Savo Nešković, Radan Dotlić and Dalibor Simić in custody, which under the Decision may last for a maximum of one (1) month, running from the day of arrest, meaning from 27 December 2022 to 27 January 2023, or pending a new decision of the Court, on the grounds referred to in Article 132(1), Subparagraphs a), b) and c) of the Criminal Procedure Code of Bosnia and Herzegovina.

The suspects are ordered in custody on account of grounded suspicion that they committed the criminal offense of Organized Crime under Article 250(2) CC BiH, as read with the criminal offenses of Illicit Trafficking in Narcotic Drugs under Article 195(1) CC BiH and Illicit Trafficking in Arms and Military Equipment and Products of Dual Use under Article 193(1) CC BiH, Money Laundering under Article 209, Paragraphs 1 and 2, as read with Paragraph 3, of the CC BiH, and Causing Public Danger under Article 394 CC RS, and due to the existence of particular custody grounds referred to in Article 132(1), Subparagraphs a), b) and c) CPC BiH, meaning the flight risk, concern that they will destroy, conceal, alter or forge the evidence and traces important for the criminal proceeding, interfere with the witnesses, accomplices and accessories, and the concern that they may repeat the offense.
