The Court of Bosnia and Herzegovina confirmed, on 28 August 2019, an Indictment filed in the case of Seid Papračanin et al. charging the accused with the commission of the criminal offenses as follows: Seid Papračanin, the criminal offense of Organized Crime under Article 250(3) in connection with the criminal offense of Illicit Trade in Excise Products under Article 210a of the Criminal Code of Bosnia and Herzegovina (KZ BiH); Ifet Papračanin, Boris Čato and Tomislav Matić, the criminal offense of Organized Crime under Article 250(2) in connection with the criminal offense of Illicit Trade in Excise Products under Article 210a of the CC BiH, and the legal entity B-label d.o.o. Vitez, under Count 2 of the Indictment, with the criminal offense of Organized Crime under Article 250(2) in connection with the criminal offense of Illicit Trade in Excise Products under Article 210a of the CC BiH.

At the arraignment held on 18 November 2019, in the case of Seid Papračanin et al., the accused Seid Papračanin, Ifet Papračanin, Boris Čato and the legal entity “B-Label” pled not guilty of the criminal offense of Organized Crime under Article 250(2) and (3) of the CC BiH, in connection with the criminal offense of Illicit Trade in Excise Products under Article 210a of the CC BiH. The accused Tomislav Matić did not attend the arraignment, so the hearing in relation to this accused will be subsequently scheduled.

At the arraignment held on 26 November 2019, in the case of Seid Papračanin et al., the accused Tomislav Matić pled not guilty of the criminal offense of Organized Crime under Article 250(2) and (3) of the CC BiH, in connection with the criminal offense of Illicit Trade in Excise Products under Article 210a. of the CC BiH.

The main trial was initiated on 19 December 2019. The prosecution is currently presenting its evidence.

Having held a hearing to entertain a Plea Agreement and a sentencing hearing in the case of Seid Papračanin et al. (S1 2 K 043070 22 K), the Court of BiH rendered and announced in open session on 6 September 2022 a Judgment finding that the accused Seid Papračanin, Ifet Papračanin and Boris Čato, by the acts described in the enacting clause of the judgment, committed the criminal offense of Associating for the Purpose of Committing Criminal Offenses under Article 249(2) of the CC BiH in concurrence with the criminal offense of Illicit Trade in Excise Products under Article 210a paragraph 1 of the CC BiH, as read with Article 53 of the CC BiH. For the criminal offense of Associating for the Purpose of Committing Criminal Offenses under Article 249(2) of the CC BiH, the Court imposed on the accused a sentence of imprisonment of nine (9) months; and for the criminal offense of Illicit Trade in Excise Products under Article 210a paragraph 1 of the CC BiH, a sentence of imprisonment of four (4) months. Pursuant to Article 53 of the CC BiH, the Court imposed on the accused a single sentence of imprisonment of one (1) year. The Court found that the legal entity B-LABEL d.o.o. Vitez, by the acts described in the enacting clause of the judgment, is responsible for the criminal offense of Associating for the Purpose of Committing Criminal Offenses under Article 249 paragraph 2 as read with paragraph 1 of the CC BiH in concurrence with the criminal offense of Illicit Trade in Excise Products under Article 210a paragraph 1 of the CC BiH, as read with Articles 53 and 124 of the CC BiH. Pursuant to Articles 131, 134 and 135 of the CC BiH, the Court imposed on the legal entity the following sentence: dissolution of the legal entity.
