On 13 January 2020, the Court of Bosnia and Herzegovina confirmed the indictment in the Milan Trišić case, which charges the accused Milan Trišić with the criminal offense of Crimes against Humanity under Article 172(1)h) as read with Subparagraphs a), d), e), f), i) and k), in conjunction with Article 180(1) and Articles 29 and 31 of the Criminal Code of Bosnia and Herzegovina.

 

At the plea hearing held on 6 February 2020, the accused Trišić Milan pled not guilty.

 

The main trial was initiated on 10 June 2020. The prosecution is currently presenting its evidence.

On 13 December 2023 the Court of Bosnia and Herzegovina delivered and pronounced a Trial Judgment in the Milan Trišić case.

The accused Milan Trišić is found guilty of the criminal offense of Crimes against Humanity under Article 172 of the Criminal Code of Bosnia and Herzegovina. The Court sentenced him to 15 (fifteen) years of imprisonment, which includes the time the accused spent in pre-trial custody from 23 October 2019 to 20 November 2019.

 

The accused is found guilty that, between April and October 1992, in the territory of Bratunac municipality, during an armed conflict in Bosnia and Herzegovina, in the framework of a widespread and systematic attack launched by the military and police of the Serb Republic of Bosnia and Herzegovina, subsequently Republika Srpska, targeting the Bosniak civilian population of Bratunac municipality, knowing of the attack and that his acts form a part of that attack, as a member of the Territorial Defense (TO) Bratunac, and later on of the Army of Republika Srpska (VRS), Bratunac Brigade VP 7042, together with other members of the TO, VRS, Bratunac Public Security Station (SJB Bratunac) and members of paramilitary units, with a discriminatory intent, he persecuted the Bosniak civilian population on national, ethnic and religious grounds in the village of Hranča and town of Bratunac, by way of killing, enforced disappearance and other inhumane acts of similar nature, committed with the intent to inflict heavy pain or serious physical or mental injuries or deterioration of health.

 

The Court acquitted the accused of some individual charges as indicated in the acquitting part of the Judgment, by which he would have committed the criminal offense of Crimes against Humanity under Article 172 CC BiH.

An appeal from the Judgment may be filed with the Appellate Division Panel within 15 days of the day when a written copy of the Judgment was received.

The Court remanded the accused Milan Trišić in custody, which under the Decision may last for a maximum of nine (9) months or until the Court issues a new decision, with the deadline running from the day of arrest.
