The accused Jasmin Keserović is charged that he became a member of a terrorist group and provided assistance to a terrorist group, and that he has publicly, via means of information, sent out a message to the public, which was aimed at inciting others to commit the criminal offense of Terrorism. The Indictment charges the accused Jasmin Keserović with the criminal offense of Organizing a Terrorist Group under Article 202d(2) as read with Paragraph 1, all in conjunction with the criminal offense of Terrorism under Article 201 of the Criminal Code BiH, and under Count 2 of the Indictment with the criminal offense of Encouraging Terrorist Activities in Public under Article 202.a CC BiH, all in conjunction with Article 53 CC BiH.

On 16 March 2020 the Court of Bosnia and Herzegovina confirmed the Indictment in the case No. S1 2 K 19812 20 Ko charging the accused Jasmin Keserović, under Count 1, with the criminal offense of Organizing a Terrorist Group under Article 202d(2) as read with Paragraph 1, all in conjunction with the criminal offense of Terrorism under Article 201 of the CC BiH, and under Count 2 of the Indictment with the criminal offense of Encouraging Terrorist Activities in Public under Article 202.a CC BiH, all in conjunction with Article 53 CC BiH.
At the arraignment held on 8 April 2020 in the case No. S1 2 K 019812 20 Ko, the accused Jasmin Keserović entered a not-guilty plea to the charges concerning the criminal offense of Organizing a Terrorist Group under Article 202d(2) as read with Paragraph 1, all in conjunction with the criminal offense of Terrorism under Article 201 of the CC BiH, and the criminal offense of Encouraging Terrorist Activities in Public under Article 202.a CC BiH, all in conjunction with Article 53 CC BiH.
On 25 February 2021, the Court of Bosnia and Herzegovina delivered a Trial Judgment in the case of Jasmin Keserović finding the accused Jasmin Keserović guilty of the criminal offense of Organizing a Terrorist Group under Article 202d(2) as read with Paragraph 1, all in conjunction with the criminal offense of Terrorism under Article 201 of the CC BiH, and the criminal offense of Encouraging Terrorist Activities in Public under Article 202.a CC BiH, all in conjunction with Article 53 CC BiH.
Concerning the criminal offense of Organizing a Terrorist Group under Article 202d(2) as read with Paragraph 1, all in conjunction with Article 201, of the CC BiH, the Court sentenced the accused Jasmin Keserović to three (3) years of imprisonment, and concerning the criminal offense of Encouraging Terrorist Activities in Public under Article 202.a CC BiH to five (5) years of imprisonment. In that regard, applying the provisions set forth in Article 53(2)b) of the CC BiH, the Court imposed on him a compound sentence of six (6) years of imprisonment.
The Appellate Division Panel held its session on 8 June 2021.
On 26 July 2021 the Court of Bosnia and Herzegovina sent out an appeals judgment of 8 June 2021 in the case of Jasmin Keserović, upholding the Court’s Trial Judgment of 25 February 2021 in its entirety.
