Judgment / Decision:
The Court of Bosnia and Herzegovina confirmed, on 29 December 2020, an indictment in the case of Toni Bašić charging the accused Toni Bašić with the commission of the criminal offense of Encouraging Terrorist Activities in Public under Article 202a, in connection with the criminal offense of Terrorism under Article 201 of the Criminal Code of BiH (CC BiH).
Having held a hearing to deliberate on a Plea Agreement and a sentencing hearing in the case of Toni Bašić, the Court rendered, on 30 March 2022, a Judgment finding the accused Toni Bašić guilty of the criminal offense of Provoking Ethnic, Racial and Religious Hatred, Discord and Intolerance under Article 145a paragraph 1 of the CC BiH. The Court imposed on the accused Toni Bašić a suspended sentence of imprisonment for a term of two (2) years. The Court also ordered that the sentence will not be executed unless the Accused commits a new criminal offense within a period of three (3) years after the judgment finality. The accused Toni Bašić also received a security measure of confiscation of objects.
