The Indictment, inter alia, alleges that the accused Zijad Mutap has organized a group for organized crime with the aim of hiding the evidence on the manner in which Dženan Memić sustained grave life-threatening bodily injuries on 8 February 2016, due to which he ultimately died, whose members became the accused Hasan Dupovac, Alisa Ramić, formerly Mutap, Josip Barić and Muamer Ožegović, so that by hiding the evidence and perpetrators, by fabricating the evidence, and by hiding the facts known to them, they undertook acts with the aim of covering up the actual manner in which Dženan Memić sustained grave life-threatening bodily injuries.

On 19 July 2021 the Court of Bosnia and Herzegovina confirmed the Indictment issued in the case of Zijad Mutap et al. charging the accused with the following criminal offenses:
- the accused Zijad Mutap with the criminal offense of Organized Crime under Article 342(3) as read with the criminal offense of Illegal Interceding under Article 382(2), the criminal offense of Accessory after the Fact under Article 346(2) of the Criminal Code of the Federation of Bosnia and Herzegovina (CC FBiH), and the criminal offense of Tampering with Evidence under Article 349(1) CC FBiH;
- the accused Alisa Ramić, formerly Mutap, the criminal offense of Organized Crime under Article 342(2) as read with the criminal offense of Accessory after the Fact under Article 346(2) of the CC FBiH, the criminal offense of Tampering with Evidence under Article 349(1) CC FBiH, and the criminal offense of Giving a False Statement under Article 348(3) as read with Paragraph 1 of the CC FBiH;
- the accused Hasan Dupovac the criminal offense of Organized Crime under Article 342(2) as read with the criminal offense of Illegal Interceding under Article 382(2), and the criminal offense of Accessory after the Fact under Article 346(2) of the CC FBiH;

At the arraignment held on August 25, 2021, the accused Zijad Mutap, Alisa Ramić formerly Mutap, Hasan Dupovac, Josip Barić, Muamer Ožegović entered a not guilty plea.
The main trial in this case commenced on 07 Oktober 2021. Currently underway is the presentation of evidence by the Prosecutor.
The Court of Bosnia and Herzegovina announced, on 24 November 2022, the first instance judgment in the case of Zijad Mutap and others (S1 2 K 040832 21 K), under which the accused Zijad Mutap, Alisa Ramić, Hasan Dupovac, Josip Barić and Muamer Ožegović are acquitted of the charges pursuant to Article 284c) of the CPC BiH, because it has not been proved that, by the acts described in the operative part of the judgment, they indeed committed the following criminal offenses:
- the accused Zijad Mutap – Organized Crime under Article 342(3) in connection with the criminal offenses of Illegal Interceding under Article 382(2), Accessory after the Fact under Article 346(2) of the Criminal Code of the Federation of Bosnia and Herzegovina (CC FBiH) and Tampering with Evidence under Article 349(1) of the CC FBiH;
- the accused Alisa Ramić - Organized Crime under Article 342(3) in connection with the criminal offenses Accessory after the Fact under Article 346(2) of the CC FBiH, Tampering with Evidence under Article 349(1) of the CC FBiH and Giving False Statement under Article 348(3) in connection with Paragraph (1) of the CC FBiH;
- the accused Hasan Dupovac - Organized Crime under Article 342(2), in connection with the criminal offenses of Illegal Interceding under Article 382(2) and Accessory after the Fact under Article 346(2) of the CC FBiH;
- the accused Josip Barić - Organized Crime under Article 342(2), in connection with the criminal offenses of Illegal Interceding under Article 382(2) and Accessory after the Fact under Article 346(2) of the CC FBiH;
- the accused Muamer Ožegović - Organized Crime under Article 342(2), in connection with the criminal offense of Accessory after the Fact under Article 346(2) of the CC FBiH.
AN appeal may be filed from this judgment before the panel of the Appellate Division of the Court of Bosnia and Herzegovina within 15 (fifteen) days after the receipt of a written copy of the judgment.
On 21 July 2023 the Appellate Division Panel of the Court of Bosnia and Herzegovina delivered an Appeals Judgment in the case of Zijad Mutap et al., finding the accused Hasan Dupovac and Alisa Ramić guilty that by the acts described in the operative part of the Judgment they committed the following offenses:
- the accused Hasan Dupovac, the continued criminal offense of Abuse of Office or Official Authority under Article 383(1) of the Criminal Code of BiH Federation, as read with Article 55 of the Code,
- the accused Alisa Ramić, the criminal offense of Giving False Statement under Article 348(3) as read with Paragraph 1 of the Criminal Code of BiH Federation.
Applying the foregoing statutory provisions, as well as Articles 41, 42, 43 and 49 of the Criminal Code of FBiH, the Court sentenced the accused Hasan Dupovac to 3 (three) years of imprisonment, and the accused Alisa Ramić to two (2) years and 6 (six) months of imprisonment. The time the accused spent in pre-trial custody, specifically Hasan Dupovac from 1 February 2021 to 15 July 2021, and Alisa Ramić from 16 June 2021 to 15 July 2021, shall be credited towards their respective prison sentences.
Conversely, pursuant to Article 284 c) CPC BIH, the accused Zijad Mutap, Alisa Ramić, Hasan Dupovac, Josip Barić and Muamer Ožegović are all acquitted of the charges, for it was not proven that they committed the criminal offenses charged against them by the Indictment, namely the criminal offense of Organized Crime under Article 342, Paragraphs 2 and 3, as read with the criminal offenses of Illegal Interceding under Article 382(2) CC FBiH, Accessory After the Fact under Article 346(2) CC FBiH, and Tampering with Evidence under Article 349(1) CC FBiH.
An appeal from the convicting part of the Judgment may be filed with the Third-Instance Panel of the Court within 15 days of the receipt of a written copy of the Judgment, whereas no appeal lies from the acquitting part of the Judgment.
