According to the Indictment, during the war and the armed conflict in BiH between the Army of BiH and the Army of Republika Srpska in the territory of the municipalities of Hadžići and Ilidža – Sarajevo, in December 1992 and July 1993, in his capacity as commander of the military formation Brnetovi četnici, operating within the 1st Igman Infantry Brigade VP 7066 Blažuj, together with members of the above formation subordinated to him, the accused Branislav Gavrilović acted in violation of Article 3, Paragraph 1, Subparagraphs a) and c) of the Geneva Convention relative to the Protection of Civilian Persons in Time of War of 12 August 1949, and Article 3, Paragraph 1, Subparagraphs a) and c) of the Geneva Convention relative to the Treatment of Prisoners of War of 12 August 1949.

By its Decision that became final on 15 January 2021, the Court of Bosnia and Herzegovina partly confirmed the Indictment in the case of Branislav Gavrilović, charging the accused Branislav Gavrilović with the criminal offense of War Crimes against Prisoners of War under Article 175.a) CC BiH as read with Articles 29 and 180(1) CC BiH. The Indictment was dismissed in relation to Count 1, while it was confirmed in the remaining part (Count 2).
