The factual substrate of the indictment:
According to the Indictment of the Prosecutor's Office of BiH, on several occasions in the period between 2013 and 2018 the Accused Sena Hamzabegović participated in gathering of and providing financial assistance to citizens of Bosnia and Herzegovina on the war theaters in Syria and Iraq knowing that those persons were fighting for the Islamic State (ISIL) and that they joined formations designated as terrorist groups and organizations by respective resolutions of the United Nations Security Council. The goal of those organizations was to destabilize and change the political and constitutional order by force, and the members of those organizations, by carrying out armed operations and attacks on the population, killings, unlawful imprisonment, taking of hostages and other acts on a daily basis, intended to coerce the legitimate authorities of Syria into changing the constitutional order and the political regime.

The Court of Bosnia and Herzegovina /BiH/ confirmed the Indictment in the case against the Accused Sena Hamzabegović on 9 September 2021, charging the Accused with the criminal offense of Funding Terrorist Activities under Article 202 paragraph (2)(b) as read with paragraph 1 of the Criminal Code of BiH.
On 17 January 2022, the Court of Bosnia and Herzegovina delivered a Judgment in the case of Sena Hamzabegović, acquitting the Accused of the charge of committing the criminal offense of Funding of Terrorist Activities in violation of Article 202 Paragraph 2(b) as read with Paragraph 1 of the Criminal Code of Bosnia and Herzegovina /CC BiH/.
Panel of the Appellate Division of the Court of BiH delivered a second-instance Judgment in the case of Sena Hamzabegović (S1 2 K 040400 22 Kž 5) on 25 May 2022, dismissing as ill-founded the appeal filed by the Prosecutor's Office of BiH and upholding the first-instance Judgment of the Court of BiH No. S1 2 K 040400 21 K dated 17 January 2022.
