The Indictment alleges, among other things, that within a widespread and systematic attack of the army and the police of Republika Srpska, being aware of such an attack and that their acts form a part of the attack, the accused planned, ordered, committed, incited, aided and abetted the planning, preparation, commission and concealing of the criminal offense of Crimes against Humanity by persecution committed by way of enforced relocation of the population, intentional depriving other persons of their lives (murder), destruction and plundering of movable and immovable property without any military need, and the destruction of a religious facility, while participating knowingly and willingly in furtherance of a joint criminal plan of the leading persons of the military, civil and police authorities in the Municipality of Sokolac, whereby they committed the criminal offense of Crime against Humanity under Article 172(1) h) in connection with Sub-paragraphs a) and d), all as read with Article 180(1) and Article 29 of the Criminal Code of Bosnia and Herzegovina (CC BiH).

On 8 January 2021 the Court of Bosnia and Herzegovina confirmed the Indictment in the case of Milan Tupajić et al. charging the accused Milan Tupajić, Dragomir Obradović, Momčilo Pajić, Miladin Gašević, Željko Gašević, Branislav Kezunović, Momir Kezunović and Jadranko Šuka with the criminal offense of Crimes against Humanity under Article 172(1)h) as read with Subparagraph a) - depriving another person of his life (murder), by the acts referred to in Count 1 of the Indictment, Subparagraph d) – deportation or forcible transfer of population, by the acts referred to in Count 1 of the Indictment, all in conjunction with Article 180(1), Articles 29 and 31 of the Criminal Code of Bosnia and Herzegovina (CC BiH).
