According to the Indictment, during the war in BiH, during the armed conflict between the Army of BiH and the Army of the Republika Srpska /VRS/, in the territory of municipalities of Mostar and Nevesinje, the accused Damir Miskin, as member of the 5th Battalion of the Nevesinje Brigade of the VRS, in violation of provisions of the Geneva Conventions prohibiting outrages upon personal dignity, in particular humiliating and degrading treatment, forced a female person to a sexual intercourse (rape).

On 2 February 2022, the Court of Bosnia and Herzegovina /BiH/ confirmed Indictment of the Prosecutor's Office of BiH dated 26 January 2022, charging the accused Damir Miskin with the criminal offense of War Crime against the Civilian Population under Article 142(1) as read with Article 22 of the Criminal Code of the Socialist Federal Republic of Yugoslavia.
Having held a hearing to deliberate on a Plea Agreement and a sentencing hearing in Case No. S1 1 K 041911 21 Kro, the Court rendered a Judgment finding the accused Damir Miskin guilty of the criminal offense of War Crimes against Civilians under Article 142(1) as read with Article 22 of the Criminal Code of the SFRY.
