The factual substrate of the indictment:
According to the Indictment, approximately between 27 and 30 July 1992, within a widespread and systematic attack launched by the military and police of the Serb Republic of Bosnia and Herzegovina, subsequently Republika Srpska, aimed against the non-Serb civilian population of the Prijedor municipality, which took place between April and September 1992, knowing of the attack and that his actions formed a part thereof, Dane Bajić, in his capacity as the Ljubija Civilian Police Station Commander and Ljubija Crisis Staff member, and Mijodrag Knežević as a member of the military-police forces of Republika Srpska, knowingly and significantly contributing to the joint criminal enterprise of civilian and military authorities of Prijedor municipality, with the intent to carry out a common plan of persecution of Bosniaks and Croats on discriminatory ethnic, religious and political grounds, together took part in the unlawful arrest of more than 120 non-Serb civilians who were then unlawfully detained and tortured, first at the local community building of Miska Glava, and then also at the Rudar F.C stadium in Ljubija; after they were detained and tortured, some 15 minor Bosniak civilians were transported to the Trnopolje camp, while at least 100 remaining civilians were taken from the Rudar F.C. stadium to the Kipe Redak site where they were all killed.
