The session of the Appellate Panel was held on 22 April 2019.
Panel of Section I for War Crimes of the Appellate Division of the Court of Bosnia and Herzegovina (Court of BiH/Court) delivered a second-instance Judgment in Case no. S1 1 K 017626 18 Krž 6, dismissing as ill-founded the respective appeals of the Prosecutor's Office of BiH and counsel for the accused Dragomir Kezunović and granting the respective appeals of counsel for the accused Dragan Marjanović, Saša Gavranović, Vitomir Dević and Zoran Šljuka. Consequently, Judgment of the Court of BiH of 12 July 2018 is reversed in the part pertaining to the decision on the punishment, as follows: the accused Dragan Marjanović, Saša Gavranović, Vitomir Dević and Zoran Šljuka, for the criminal offense of Crimes against Humanity under Article 172 paragraph 1 subparagraph (h) as read with subparagraph (a), all in conjunction with Article 180(1) and Article 29 of the CC BiH, for which they have been found guilty under the trial judgment, are sentenced to imprisonment: Dragan Marjanović - 14 (fourteen) years' imprisonment; Saša Gavranović , Vitomir Dević and Zoran Šljuka - 15 (fifteen) years' imprisonment each. The trial judgment shall otherwise remain unaffected.
