Having held a guilty plea agreement consideration hearing and a sentencing hearing in the case of Admir Jakupović et al., on 13 November 2023 the Court of BiH delivered and pronounced a Judgment finding the accused Admir Jakupović, Ermin Ljumić, Mirza Serdarević, Melir Hodžić and Al Rijad Fazlić guilty that in the manner described in the operative part of the Judgment they committed the criminal offense of Organized Crime under Article 250 of the Criminal Code of BiH in conjunction with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195 CC BiH, and the accused Admir Jakupović and Ermin Ljumić also the criminal offense of Illicit Trafficking in Arms and Military Equipment and Products of Dual Use under Article 193 CC BiH.

The Court sentenced the accused in the manner as follows:

• the accused Admir Jakupović to three (3) years of imprisonment. The time the accused spent in pre-trial custody, from 10 May 2021 to 8 June 2021, shall be credited towards his sentence of imprisonment;
• the accused Ermin Ljumić to two (2) years and three (3) months of imprisonment. The time the accused spent in pre-trial custody, from 30 April 2021 to 26 May 2021, shall be credited towards his sentence of imprisonment;
• the accused Mirza Serdarević to one (1) year of imprisonment, plus a fine in the amount of 15,000.00 BAM (fifteen thousand convertible marks). The time the accused spent in pre-trial custody, from 10 May 2021 to 8 June 2021, shall be credited towards his sentence of imprisonment;
• the accused Melir Hodžić to one (1) year of imprisonment, plus a fine in the amount of 1,000.00 BAM (one thousand convertible marks);
• the accused Al Rijad Fazlić to one (1) year of imprisonment, plus a fine in the amount of 1,000.00 BAM (one thousand convertible marks). The time the accused spent in pre-trial custody, from 10 May 2021 to 8 June 2021, shall be credited towards his sentence of imprisonment.

Also, the instrumentalities shall be confiscated from the accused.

The accused were, inter alia, found guilty that between January 2020 and 10 May 2021 they existed as a group for organized crime which operated in the territory of Bosnia and Herzegovina, the Netherlands and France for the purpose of committing criminal offenses.

Legal remedy note: No appeal lies from the decision on criminal sanction, but the Judgment may be appealed on other grounds with the Appellate Division Panel of the Court of BiH within 15 (fifteen) days of the day when a written copy thereof was received.
