The Court of Bosnia and Herzegovina /Court/ delivered a second-instance Judgment in the case of Obrad Radovanović et al. on 9 December 2021, finding the accused guilty of the criminal offense of Associating for the Purpose of Committing Criminal Offenses under Article 249(2) of the Criminal Code of Bosnia and Herzegovina /CC BiH/ and the criminal offense of Receiving Gifts or Other Forms of Benefit under Article 217(1) of the CC BiH, taken in conjunction with Articles 29 and 53 thereof.

The Court imposed a fine on the accused Obrad Radovanović in the amount of 5,000.00 BAM for the criminal offense of Associating for the Purpose of Committing Criminal Offenses under Article 249(2) of the CC BiH and fixed a sentence of imprisonment for a term of one (1) year for the criminal offense of Receiving Gifts or Other Forms of Benefit under Article 217(1) of the CC BiH. The Court imposed on the Accused a sentence of imprisonment for a term of one (1) year and a fine in the amount of 5,000.00 BAM. The Accused was ordered to pay the fine to the Budget of BiH within six (6) months after the Judgment became final. Pursuant to Article 47(2) of the CC BiH, should the Accused fail to pay the fine within the set deadline, the Court shall substitute the fine with imprisonment.

The Court imposed a fine on the accused Zahid Delić in the amount of 3,000.00 BAM for the criminal offense of Associating for the Purpose of Committing Criminal Offenses under Article 249(2) of the CC BiH and fixed a sentence of imprisonment for a term of eight (8) months for the criminal offense of Receiving Gifts or Other Forms of Benefit under Article 217(1) of the CC BiH. The Court imposed on the Accused a sentence of imprisonment for a term of eight (8) months and a fine in the amount of 3,000.00 BAM. The Accused was ordered to pay the fine to the Budget of BiH within six (6) months after the Judgment became final. Pursuant to Article 47(2) of the CC BiH, should the Accused fail to pay the fine within the set deadline, the Court shall substitute the fine with imprisonment.

The Court imposed a fine on the accused Mate Delić in the amount of 1,000.00 BAM for the criminal offense of Associating for the Purpose of Committing Criminal Offenses under Article 249(2) of the CC BiH and fixed a sentence of imprisonment for a term of six (6) months for the criminal offense of Receiving Gifts or Other Forms of Benefit under Article 217(1) of the CC BiH. The Court imposed on the Accused a sentence of imprisonment for a term of six (6) months and a fine in the amount of 1,000.00 BAM. The Accused was ordered to pay the fine to the Budget of BiH within six (6) months after the Judgment became final. Pursuant to Article 47(2) of the CC BiH, should the Accused fail to pay the fine within the set deadline, the Court shall substitute the fine with imprisonment.
