Suspects in Amel Bogučanin et al. ordered in custody

In the case of Amel Bogučanin et al. (S1 2K 044616 22 Krn), ruling on the Motion filed by the BiH Prosecutor's Office on 15 December 2022 to order custody of the suspects Amel Bogučanin and Bojan Drakul, having held a public hearing to consider the Prosecutor’s Motion, on 15 December 2022 the Court of Bosnia and Herzegovina issued a Decision ordering custody of the suspects Amel Bogučanin and Bojan Drakul, which under the Decision may last for a maximum of one (1) month, running from the day of their arrest, which means from 13 December 2022 to 13 January 2023 or pending a new decision of the Court.

The suspects are ordered in custody on grounded suspicion that they committed the criminal offense of Organized Crime under Article 250, Paragraphs 2 and 3, of the Criminal Code of Bosnia and Herzegovina (CC BiH), as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195 CC BiH, due to existence of particular custody grounds referred to in Article 132(1), Subparagraphs a), b) and c) of the CPC BiH, which is the flight risk, the concern that the suspects will destroy, conceal, alter or forge the evidence and traces important for the criminal proceeding, interfere with the witnesses, accomplices and accessories, and the concern that they may repeat the offense.
