Appeals Judgment sent out in Milan Špirić case

In the case of Milan Špirić (S1 2 K 031124 22 Kž), acting upon BiH Constitutional Court Decision of 2 November 2022, and in that regard ruling on the appeals of the BiH Prosecutor's Office, the accused Milan Špirić in person, and his defense counsel, filed from the Judgment of the Court of Bosnia and Herzegovina of 13 October 2020, having held an open session, on 21 December 2022 the Appellate Division Panel of the Court of Bosnia and Herzegovina delivered an Appeals Judgment dismissing as ill-founded the appeals filed by the BiH Prosecutor's Office, the accused Milan Špirić in person and his defense counsel, and upheld the Judgment of the Court of BiH of 13 October 2020.

The Trial Judgment of the Court of BiH dated 13 October 2020 found the accused Milan Špirić guilty that by the acts described in the operative part of the Judgment he committed the criminal offense of Accepting Gifts and Other Forms of Benefit under Article 217(1) of the Criminal Code of Bosnia and Herzegovina (CC BiH), as read with Article 29 CC BiH, and sentenced him to 1 (one) year of imprisonment.

 

On 22 February 2021, the Appellate Division Panel of the Court of Bosnia and Herzegovina held an open session concerning the appeals filed from the Trial Judgment by the BiH Prosecutor's Office and the Defense for the accused Špirić, after which it delivered the Appeals Judgment, fully upholding the Trial Judgment.

 

The accused Milan Špirić has filed an appellation with the BiH Constitutional Court, which held a session on 2 November 2022, granted Milan Špirić’s appellation, and issued a Decision revoking the Court of BiH Judgment of 22 February 2021, and remanding the case to the Court of BiH for reconsideration.

 

No appeal lies from this Judgment.
