Accused in Dalibor Railić et al. ordered in continued custody

Ruling on the Prosecutor’s Motion on continued custody following Indictment confirmation of 15 December 2022, having held a public hearing in the case of Dalibor Railić et al. (S1 2 K 044546 22 Ko), on 21 December 2022 the Court of Bosnia and Herzegovina issued a decision ordering the accused Dalibor Railić, Aleksandar Mijatović and Igor Repajić in continued custody on particular custody grounds referred to in Article 132(1), Subparagraph a), b) and c), of the CPC BiH, which under the Decision may last until the pronouncement of a trial judgment, or pending a new decision of the Court, but in any case not longer than three (3) years following Indictment confirmation, meaning until 15 December 2025.

The suspects were ordered in custody on grounded suspicion that they committed the offenses as follows: the accused Dalibor Railić – the criminal offense of Organized Crime under Article 250(3) CC BiH as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) CC BiH, the criminal offense of Money Laundering under Article 209(3) as read with Paragraph 1 CC BiH, and the criminal offense of Aggravated Murder under Article 125(2) as read with Paragraph 1, of the Criminal Code of Republika Srpska (CCRS), all in conjunction with Article 53 CC BiH; the accused Aleksandar Mijatović – the criminal offense of Organized Crime under Article 250(2) as read with the criminal offense of Aggravated Murder under Article 125(2) as read with Paragraph 1 CCRS, and the accused Igor Repajić – the criminal offense of Organized Crime under Article 250(2) as read with the criminal offense of Aggravated Murder under Article 125(2) and Article 39(2) Aiding and Abetting, of the CCRS; as well as on particular custody grounds referred to in Article 132(1), Subparagraphs a), b) and c) CPC BiH in relation to all the accused, meaning the flight risk, a concern that the accused may destroy, conceal, alter or forge the evidence and traces important for the criminal proceeding, interfere with the witnesses, accomplices and accessories, and a concern that they may repeat the offense.

 

Justifiability of the imposed custody measure shall be checked on a bi-monthly basis running from the day of issuance of the most recent decision on custody.

 

An appeal from this Decision may be filed with the Special 24(7) Panel of the Court within three (3) days of the day when the written copy of the Decision was served. The appeal from the Decision shall not stay its execution.
