First Instance Judgment Announced in the Case of Rade Macura

The Court of Bosnia and Herzegovina delivered and on 18 October 2023 publicly announced the first instance judgment acquitting the accused Rade Macura of the charges that, by the acts described in the operative part of the judgment, he committed the criminal offense of War Crimes against Civilians under Article 173(1) c) of the Criminal Code of BiH, as read with Article 180(2) of the same Code.

The accused Rade Macura is acquitted of the charges because it was not proved that, during the war in Bosnia and Herzegovina and an armed conflict between the Army of Republika Srpska and the Army of the Republic of Bosnia and Herzegovina, as a member of the Army of Republika Srpska, in the capacity of a commander of the I Company of the II Battalion of the I Light Gradiška Brigade, he acted in contravention of the rules of international humanitarian law by violating the provisions of the Geneva Convention relative to the Protection of Civilian Persons in Time of War and Protocols I and II additional to the Geneva Conventions, in as much as he, as a superior officer, omitted to take the necessary and reasonable measures to punish the perpetrators of the criminal offense subordinated to him.

An appeal from this judgment may be filed with a panel of the Appellate Division of the Court of BiH within a period of 15 days after the receipt of the written judgment.
