Having held a hearing in the case of Željko Radovanović et al. (S1 2 K 042622 22 Krn) to rule on the Prosecutor’s Motion of 13 January 2023 to order custody of the suspect Mile Rosić, on 13 January 2023 the Court of Bosnia and Herzegovina issued a Decision to grant the Prosecutor’s Motion, and ordered custody of the suspect Mile Rosić, which under the Decision may last for a maximum of one (1) month, running from the day of arrest, meaning from 12 January 2023 to 12 February 2023, or pending a new decision of the Court, on particular custody grounds referred to in Article 132(1), Subparagraphs a), b) and c), of the CPC BiH.
The suspect is ordered in custody on grounded suspicion that he committed the criminal offense of Organized Crime under Article 250, Paragraphs 2 and 3, of the CC BiH, as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) CC BiH, as well as the existence of particular custody grounds referred to in Article 132(1), Subparagraphs a), b) and c), of the CPC BiH, meaning the flight risk, the concern that the suspects may destroy, conceal, alter or forge the evidence and traces important for the criminal proceeding, interfere with the witnesses, accomplices and accessories, and the concern that they may repeat the offense.
On 16 May 2022 the Court issued a first Decision ordering the suspect Mile Rosić in custody. Since at the time the suspect was not available to the BiH judicial institutions, by its Decision of 27 May 2022 the Court issued an order to have a central and international arrest warrant issued for the suspect Mile Rosić. The suspect was arrested on 12 January 2023 in accordance with the arrest warrant.
An appeal from the Decision shall not stay its execution.
