Having held a guilty plea agreement consideration hearing and a sentencing hearing, on 29 October 2021 the Court of Bosnia and Herzegovina delivered and publicly pronounced the judgment finding the accused Dalibor Mačak guilty of the criminal offense of Organized Crime under Article 250(3) CC BiH, in conjunction with the criminal offense of Illicit Trafficking in Arms and Military Equipment and Products of Dual Use under Article 193(1) CC BiH, Illicit Trafficking in Narcotic Drugs under Article 195(1) CC BiH, Unauthorized Production and Sale of Narcotics under Article 207(1) CC RS and Illegal Manufacture and Selling of Weapons or Explosive Substances under Article 361(1) CC RS, all as read with Article 53 CC BiH. The Court sentenced the accused to 8 (eight) years of imprisonment.
The accused Dalibor Mačak was, inter alia, found guilty that between December 2018 and late June 2019, in the territory of Bosnia and Herzegovina, with the aim of obtaining ill-gotten gain through unauthorized trafficking in weapons and military equipment in the territory of Bosnia and Herzegovina and Austria, he organized a group of people in terms of Article 1(21) CC BiH, to whose members, through direct or indirect contacts, he gave instructions about the time, place and method in which to hide and transport large quantities of previously procured explosive and narcotic drugs from Bosnia and Herzegovina across international borders to buyers known to him in Austria.
