Appeals Judgment delivered in Nenad Radetić et al.

On 23 May 2024 the Appellate Division Panel of the Court of Bosnia and Herzegovina delivered an Appeals Judgment in the case of Nenad Radetić et al.  (S1 2 K 044550 24 Kž), dismissing as ill-founded the appeals filed by defense counsel for the accused Nenad Radetić and Jugoslav Tepić, and upheld the Trial Judgment of the Court of Bosnia and Herzegovina dated 28 December 2023.

The Trial Judgment of the Court of Bosnia and Herzegovina of 28 December 2023 found the accused Nenad Radetić and Jugoslav Tepić guilty of the criminal offense of Accepting Gifts or Other Forms of Benefit under Article 217(1) of the Criminal Code of Bosnia and Herzegovina (CC BiH), as read with Article 29 CC BiH. The Court sentenced the accused Nenad Radetić to 8 (eight) months of imprisonment, and the accused Jugoslav Tepić to 6 (six) months of imprisonment. Under the same Judgment, the ill-gotten gain in the amount of 100.00 EUR was confiscated from the accused Nenad Radetić.

The accused have been found guilty that, on 16 October 2020, at around 7 a.m., at the international border crossing of “Gradiška” between Bosnia and Herzegovina and Croatia, while performing their duties and tasks of authorized official persons – police officers of the BiH Border Police, while carrying out border checks of persons and vehicles entering from Croatia to Bosnia and Herzegovina, with the intent of doing, for a monetary compensation, within their office, what they should not be doing, they demanded and received a gift in the form of money, and thus enabled foreign citizens illegal entry into BiH.
