Having held an open hearing, on 24 September 2024 the Court of Bosnia and Herzegovina delivered and pronounced a Trial Judgment, acquitting the accused Ognjen Stupar of all charges, for it was not proven that by the acts described in the operative part of the Judgment he committed the criminal offense he was charged with.
The Indictment charged the accused with the criminal offense of Fraud in Office under Article 222(2) CC BiH, in the way that between 1 February 2022 and 31 August 2023, in his capacity as an official person in the institutions of Bosnia and Herzegovina, performing the duties of commander at the BiH Border Police, GPBiH Unit Banja Luka Airport, aware of his unlawful activities, yet wanting to commit them, for the purpose of obtaining ill-gotten gain, he misled an official person at the BiH Border Police into making an unlawful payment for accommodation expenses and family separation allowance, which is how he obtained ill-gotten gain in the total amount of 10,652.26 BAM, which is the amount of damage caused to the budget of Bosnia and Herzegovina.
