The Appellate Division Panel of the Court of Bosnia and Herzegovina on 5 July 2022 delivered and on 27 July 2022 sent out an appeals judgment in the case of Cvijan Tomanić, which dismissed as ill-founded the appeal filed by the Prosecutor's Office of Bosnia and Herzegovina, the appeal filed by the accused Cvijan Tomanić, as well as the appeal filed by defense counsel, attorney Predrag Ješurić, and upheld the Trial Judgment of the Court of Bosnia and Herzegovina No. S1 1 K 031188 19 Kri of 30 September 2021.
The Trial Judgment of the Court of Bosnia and Herzegovina found the accused Cvijan Tomanić guilty of the criminal offense of Crimes against Humanity under Article 172(1)h) as read with Subparagraphs a) and k), of the Criminal Code of Bosnia and Herzegovina, all in conjunction with Articles 29 and 180(1) of the CC BiH. The Court sentenced the accused Cvijan Tomanić to seven (7) years of imprisonment.
The accused has been found guilty that between April 1992 and at least late 1992, in the municipality of Zvornik, in the framework of a widespread and systematic attack of the Army of Republika Srpska, aimed at the non-Serb civilian population in the territory of Zvornik municipality, the accused Cvijan Tomanić, as a member of the Army of Republika Srpska (VRS), VP7469 Zvornik Brigade, knowing of the attack and that his actions form a part of the attack, took part in the persecution of the Bosniak civilian population on ethnic and religious grounds in relation to murder and other inhumane acts of similar nature, committed with the intent of inflicting great suffering or serious physical or mental injury or deterioration of health.
No appeal lies from this Judgment.
