Appeals Judgment delivered in Edhem Godinjak et al.

On 26 April 2022 the Appellate Division Panel of the Court of Bosnia and Herzegovina issued an Appeals Judgment in the case of Edhem Godinjak et al., dismissing as ill-founded the appeal filed by the Prosecutor's Office of Bosnia and Herzegovina and upholding the Court of BiH Judgment No. S1 1 K 016301 14 Kri dated 4 March 2021.

Trial Judgment of the Court of Bosnia and Herzegovina No. S1 1 K 016301 14 Kri dated 4 March 2021 had acquitted the accused Edhem Godinjak, Medaris Šarić and Mirko Bunoza, pursuant to Article 284c) of the Criminal Procedure Code of Bosnia and Herzegovina, of the charges that they committed the criminal offense of War Crimes against Civilians under Article 173(1), Subparagraphs c) and e), and the criminal offense of War Crimes against Prisoners of War under Article 175(1) Subparagraphs a) and b), of the Criminal Code of Bosnia and Herzegovina, as read with Article 180(1) CC BiH.

 

The accused were acquitted of the charges as follows: that Edhem Godinjak, in his capacity as Head of the Trnovo Public Security Station, Medaris Šarić, in his capacity as Trnovo Territorial Defense Staff Commander, and Mirko Bunoza, in his capacity as HV-HOS Commander, knowingly and willingly participated in a joint criminal enterprise with a common design of multiple killing of Serbs in the villages in Trnovo Municipality, unlawful arrest and detention in detention facilities formed in the territory of Trnovo Municipality and burning their property, and killing of and according inhuman treatment to the captured members of the Republika Srpska Army in the detention facilities formed  in the territory of Trnovo Municipality.
