Having held a trial, on 10 November 2023 the Appellate Division Panel of the Court of BiH delivered an Appeals Judgment in the case of Mladen Bošnjak et al. (S1 2 K 024306 23 Kžk), finding the accused Bojan Drakul guilty that, in the manner described in the Judgment, he committed the criminal offense of Organized Crime under Article 250(1) as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) of the Criminal Code of Bosnia and Herzegovina.

The Court sentenced the accused to 3 (three) years and 6 (six) months of imprisonment, and fined him with 20,000.00 BAM, which the accused shall pay within 30 days of the day when the Judgment becomes final.

The accused has been found guilty because, inter alia, between 25 November 2016 and 3 December 2016, together with other members, he became a member of a group for organized crime, which had been previously organized by a person known to him. The group was organized for the purpose of obtaining ill-gotten gain by way of illicit international sale, transfer, transport, keeping, acting as a go-between in further international sale, and by sending and supplying the narcotic drug of marijuana.

No appeal lies from the Judgment.

The Trial Judgment of the Court of Bosnia and Herzegovina dated 21 February 2023 had found the accused M.B. and Bojan Drakul guilty of the criminal offense of Organized Crime under Article 250(1) as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) of the CC BiH. The Court sentenced each of them to four (4) years of imprisonment, and fined them with 20,000.00 BAM each.

Ruling on the appeal filed by defense counsel for the accused Bojan Drakul, on 31 May 2023 the Appellate Division Panel delivered a Judgment granting the appeal and revoking the Judgment of this Court of 21 February 2023 in relation to the accused, and ordering a trial before the Appellate Division Panel of the Court of Bosnia and Herzegovina.
