Appeals judgment pronounced in Adem Kostjerevac

Following a trial, on 21 December 2021 the Appellate Division Panel of the Court of Bosnia and Herzegovina publicly announced an appeals judgment in the Adem Kostjerevac case, finding the accused Adem Kostjerevac guilty of the criminal offense of War Crimes against Civilians under Article 142(1) of the Criminal Code of SFRY. The Appellate Division Panel of the Court of Bosnia and Herzegovina sentenced him to 7 (seven) years of imprisonment.

The accused Adem Kostjerevac was found guilty that during the war and armed conflict in Bosnia and Herzegovina, as a member of the Military Police of the 1st Muslim Brigade of Zvornik, Army of BiH, between 18 September 1992 and 4 October 1992, in the territory of Zvornik municipality, he acted in contravention of the rules of international humanitarian law, in violation of Article 3(1), Subparagraphs a) and c), and Article 27 of the Geneva Convention Relative to the Protection of Civilian Persons in Time of War of 12 August 1949, by forcing a female civilian to sexual intercourse.

 

The Trial Judgment of the Court of Bosnia and Herzegovina of 12 March 2021 had dismissed the charges that the accused Adem Kostjerevac committed the criminal offense of War Crime against Civilians under Article 142(1) of the Criminal Code of SFRY.
