Having held a hearing to entertain a statement on the admission of guilt and a sentencing hearing in the case of Dejan Ivaštanin, the Court of Bosnia and Herzegovina /Court/ delivered a Judgment on 17 March 2022, finding the accused Dejan Ivaštanin guilty of the criminal offense of Receiving Gifts or Other Forms of Benefit under Article 217(1) of the Criminal Code of Bosnia and Herzegovina /BiH/. The Court sentenced the Accused to six (6) months' imprisonment.
The Court imposed on the Accused a security measure of ban on carrying out occupation, activity or duty, prohibiting the Accused from performing the duties of police officer in the Border Police of BiH for a period of three years running from the date the judgment becomes final; the time spent serving the sentence of imprisonment is not credited towards the term of the security measure. The gift received by the Accused in the amount of EUR 30.00 is confiscated and the Accused is ordered to pay that sum into the Budget of BiH within 30 days after the Judgment became final.
The accused Dejan Ivaštanin is guilty because during the inspection of passenger vehicles and buses he, as an official person in an institution of BiH-police officer of the Border Police of BiH, demanded and received a benefit for himself in order to perform, within the scope of his official function, an act he was not allowed to perform.
