Trial Judgment pronounced in Mirza Kapić case

Having completed the trial in the case of Mirza Kapić, on 3 February 2025 the Court of BiH delivered and pronounced a Trial Judgment finding the accused Mirza Kapić guilty that by the acts described in the operative part of the Judgment he committed the criminal offense of Terrorism under Article 201(4) as read with Paragraph 1 and Paragraph 5f) of the Criminal Code of Bosnia and Herzegovina.

The Court sentenced him to 4 (four) years and 6 (six) months of imprisonment. The time the accused spent in pre-trial custody, from 4 August 2023 onwards, shall be credited towards his sentence of imprisonment.

 

The accused was found guilty that in July 2023, in the territory of BiH, with the aim of seriously intimidating the population and destabilizing the society, together with persons known to him, using the “Telegram” and “Threema” applications, via his mobile phone, he arranged and planned an attack on the “Bosna” mosque in Zenica during 2023, which he intended to carry out by setting there an explosive device made of mercury-based explosive and TNT, with the aim of punishing the Islamic community scholars and members in BiH who have been issuing fatwas against the terrorist organization of ISIS, and punishing those members of the Islamic community in BiH who have been reporting ISIS members to the BiH law enforcement agencies. 

 

In the same case, the Court issued a Decision remanding the accused in continued custody, so that under the Decision it may last for a maximum of 9 (nine) months running from the day when the Judgment was delivered, or until the Court issues a new decision.
