Court of Bosnia and Herzegovina Holds Plenary Session

On 7 December 2022 the Plenum of the Court of Bosnia and Herzegovina held a session to discuss Judge Branko Perić’s request for recusal from the criminal case of Fadil Novalić et al.

Judge Branko Perić, Panel Presiding in the case of Fadil Novalić et al., has filed a request for recusal from the given case, pursuant to Article 29(1)f) of the Criminal Procedure Code of Bosnia and Herzegovina. The foregoing provision stipulates that a judge cannot perform his duties as a judge if circumstances exist that raise a reasonable suspicion as to his impartiality.

 

Out of the total of 47 judges, 37 judges who attended the session voted on the request, all of them voting to deny the request for recusal, since the Plenum holds that it was not determined that there exist circumstances that raise a reasonable suspicion as to Judge Perić’s impartiality in the present case.
