On 31 May 2023 the Appellate Division Panel of the Court of Bosnia and Herzegovina delivered an Appeals Judgment in the case of Mladen Bošnjak et al., partly granting the appeal filed by defense counsel for the accused Mladen Bošnjak, so the Judgment of the Court of Bosnia and Herzegovina dated 21 February 2023 is modified in the part concerning the primary sentence, so the accused Mladen Bošnjak is now sentenced to 3 (three) years and 6 (six) months of imprisonment for the criminal offense of Organized Crime under Article 250(1) of the Criminal Code of Bosnia and Herzegovina (CC BiH), as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) CC BiH, of which he has been found guilty.

The same Judgment also granted the appeal filed by defense counsel for the accused Bojan Drakul, so the Judgment of the Court of Bosnia and Herzegovina dated 21 February 2023 is revoked in relation to the accused Drakul, and a retrial is ordered before the Appellate Division Panel of the Court of Bosnia and Herzegovina.

The Trial Judgment of the Court of Bosnia and Herzegovina dated 21 February 2023 found the accused Mladen Bošnjak and Bojan Drakul guilty of the criminal offense of Organized Crime under Article 250(1) of the Criminal Code of Bosnia and Herzegovina (CC BiH), as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) CC BiH. The Trial Court sentenced them each to four (4) years of imprisonment, and also fined them with 20,000.00 BAM each.

No appeal lies from this Judgment.
