Judgment Announced in the Case of Nijaz Halilović and Others

Having held a main trial in the case of Nijaz Halilović et al. (S1 2 K 041113 24 K), the Court of BiH delivered, and on 17 April 2025 publicly announced a trial judgment finding the accused Nijaz Halilović and Đorđe Mijović guilty of the criminal offense of Accepting Gifts and Other Forms of Benefit under Article 217(1) of the CC BiH, as read with Article 29 of the CC BiH.

The Court sentenced the accused Nijaz Halilović and Đorđe Mijović to imprisonment for a term of six (6) months each.

 

The gift accepted by the accused Nijaz Halilović in the amount of 20.00 EUR will be confiscated, which amount will be paid towards the BiH budget after finality of the judgment.

 

The accused Nijaz Halilović and Đorđe Mijović are found guilty because, on 26 August 2021, at the international border crossing Hum, Foča municipality, in the capacity of official persons in BiH institutions, as police officers of the BiH Border Police, assigned in the Border Police Unit Hum, specifically, Nijaz Halilović as a team leader at the border crossing, and Đorđe Mijović as a border control police officer, with the rights and obligations ensuing from the authorities provided for by the Law on the BiH Border Police, namely Đorđe Mijović, while performing border control of passengers at the entrance in Bosnia and Herzegovina from the direction of Montenegro, after establishing that passenger E. X. did not possess any proof indicated in the Decision prescribing additional requisites for the entrance of aliens in BiH ("Official Gazette of BiH", Nos. 57/2020, 58/2020, 36/2021 and 28/2022), passed by the BiH Council of Ministers, adopted at the 39th session of the BiH Council of Ministers, specifically, the alternatively prescribed requisites: a negative finding of the PCR test or quick anti-genetic test for the SARS-CoV-2 virus, not older than 48 hours, or vaccination certificate, or a certificate issued by a physician that a person had overcome the COVID-19 ailment, allowed the referenced passenger to get off a bus and enter the official premises of the BiH Border Police at the international border crossing Hum, which is where Nijaz Halilović was present. On the referenced occasion, Đorđe Mijović orally informed Nijaz Halilović about the then status of passenger E. X., whereupon the two police officers of the BiH Border Police, by using the learned information that the passenger did not fulfil the prescribed additional requirements for the entry of aliens in BiH, and with the aim to obtain illicit property gain, requested and accepted from passenger E. X. a monetary gift in the amount of 20.00 EUR, in order that they do not perform the official act they should perform, having thus enabled passenger E. X. to enter BiH.
