Having held a hearing to entertain a Plea Agreement and a sentencing hearing, the Court of Bosnia and Herzegovina delivered a Judgment in open session on 11 April 2022, finding the accused Damir Miskin guilty of the criminal offense of War Crime against the Civilian Population under Article 142(1) as read with Article 22 of the Criminal Code of the SFRY. The Court sentenced the Accused to four (4) years' imprisonment.
The accused Damir Miskin has been found guilty because he, during the war in Bosnia and Herzegovina, during the armed conflict between the Army of the Republic of BiH and the Army of the Republika Srpska /VRS/ in the territory of Mostar and Nevesinje municipalities, as member of the 5th Battalion of the Nevesinje Brigade of the VRS, acted in violation of rules of international humanitarian law, breaching the provisions of common article 3 and article 27 of the Geneva Convention relative to the Protection of Civilian Persons in Time of War of 12 August 1949 by forcing a female person to a sexual intercourse (rape).
