Having held a guilty plea agreement consideration hearing and a sentencing hearing in the case of Denis Stojnić (S1 2 K 044279 24 K), on 21 January 2025 the Court delivered and pronounced a Judgment, finding the accused Denis Stojnić guilty of the criminal offense of Accepting Gift or Other Forms of Benefit for Trading in Influence under Article 219(1) CC BiH, as read with Articles 29 and 54 of the Code.
The Court sentenced the accused to one (1) year of imprisonment, on proviso that the period he spent in pre-trial custody, from 29 October 2022 to 31 October 2022, is credited towards his sentence of imprisonment.
The Court also fined the accused with 40,000.00 BAM, which he shall pay within 1 (one) year, running from the day when the Judgment becomes final.
The ill-gotten gain in the amount of 46,447.00 BAM shall be confiscated from the accused Denis Stojnić, which he shall pay towards the BiH budget within 1 (one) year of the day when the Judgment becomes final.
The accused is found guilty that, between 3 March 2021 and late October 2022, he, directly and indirectly, demanded and from three persons received financial gain for himself and for another, so that, by using his actual and assumed position of influence, he should intercede that an official person in the institutions of Bosnia and Herzegovina performs or does not perform an official act he/she has a duty to perform or not perform under the law.
In the same case, the Court issued a Decision rescinding the previously imposed restrictive measures, namely the ban on meeting with specific individuals and the mandatory periodical reporting to a state authority. The same Decision extended the travel ban that has been previously imposed on the accused, all under Article 126 CPC BiH.
