Having held a guilty plea agreement consideration hearing and a sentencing hearing in the case of Ensar Salčinović (S1 2 K 045638 23 K), on 11 May 2023 the Court delivered and pronounced a Judgment finding the accused Ensar Salčinović guilty that by the acts described in the Judgment he committed the criminal offense of Associating for the Purpose of Perpetrating Criminal Offences under Article 249(2) CC BiH and the criminal offense of Accepting Gifts and Other Forms of Benefit under Article 217(1) CC BiH, all in conjunction with Articles 53 and 54 CC BiH.
The Court imposed the following punishment on the accused:
- for the criminal offense of Associating for the Purpose of Perpetrating Criminal Offences under Article 249(2) CC BiH – a fine in the amount of 500.00 BAM;
- for the criminal offense of Accepting Gifts and Other Forms of Benefit under Article 217(1) CC BiH – a sentence of 1 (one) year of imprisonment.
The Court ultimately imposed on the accused a compound sentence of one (1) year of imprisonment, including the time he spent in custody, from 24 September 2021 to 31 December 2021, and fined him with 500.00 BAM, which he must pay within 30 (thirty) days of the day when the judgment becomes final. Based on the statutory provisions, the ill-gotten gain in the amount of 500.00 BAM shall be confiscated from the accused Ensar Salčinović, which he shall pay towards the BiH budget within 30 (thirty) days of the day when the judgment becomes final, under the threat of enforcement.
Also based on the statutory provisions, the security measure of ban on carrying out a certain activity or duty is hereby imposed on the accused Ensar Salčinović, to remain in force for 3 (three) years since the day when the judgment becomes final, with the time spent serving the sentence of imprisonment not being credited towards the duration of the imposed security measure
The accused Ensar Salčinović has been found guilty that, between November 2020 and 24 September 2021, in the territory of Bosnia and Herzegovina, in his capacity as an official person – employee of the BiH Border Police, he demanded and received gifts from the candidates who applied for a vacancy - the position of cadets with the ranks of “junior inspector” and “police officer” at the BiH Border Police, the gifts being intended for himself and for other persons known to him, so that by the described acts he would favor particular candidates and facilitate their appointment at the BiH Border Police, in contravention of the legal provisions regulating the method of recruiting/appointing cadets at the BiH Border Police.
