Having held a guilty plea agreement consideration hearing and a sentencing hearing in the case of Marko Drobnjak, on 6 March 2025 the Court delivered and pronounced a Trial Judgment, finding the accused Marko Drobnjak guilty of the criminal offense of Accepting Gifts and Other Forms of Benefit under Article 217(2) CC BiH.
The Court sentenced the accused to five (5) months of imprisonment.
The Court confiscated from the accused the gift he received, in the amount of 20.00 BAM, which he shall pay towards the budget of Bosnia and Herzegovina within 30 (thirty) days of the day when the Judgment becomes final.
The accused was found guilty that, on 1 January 2022, at between 17:45 and 18:30 hours, in his capacity as an official person in the institutions of Bosnia and Herzegovina, as a police officer in the BiH Border Police, with the aim of acquiring ill-gotten gain for himself, in the course of carrying out border checks at the entry point to Bosnia and Herzegovina from Croatia, he demanded and received a gift in the form of money from a passenger who did not possess the necessary and valid documents for entry and stay in the territory of BiH, so that within his office he does not do something that he ought to do under the law, meaning that he omitted to file misdemeanor charges against the person, but instead allowed him to enter Bosnia and Herzegovina without conducting any misdemeanor proceedings, whereby he committed the criminal offense of Accepting Gifts and Other Forms of Benefit under Article 217(2) CC BiH.
