On 17 May 2022, the Court of Bosnia and Herzegovina delivered and pronounced a Trial Judgment in the Agan Ramić case, by which the accused Agan Ramić, pursuant to Article 284c) CPC BiH, is acquitted of the charges that he committed the criminal offense of Crimes against Humanity under Article 172(1)h) as read with Subparagraph f), of the Criminal Code of Bosnia and Herzegovina, all in conjunction with Articles 29 and 180(1) of the Code, for it was not proven that the accused committed the criminal offense he was charged with in the Indictment.
The accused Agan Ramić is acquitted of the charges that during the armed conflict in BiH between the first half of April 1992 and late November 1995 at the latest, between the armed forces of the Republika Srpska Army (VRS) on the one side, and the Army of the Republic of BiH and the Croat Defense Council (HVO) on the other, during or about a period between mid-May 1992 and early May 1993, within a widespread and systematic attack by members of the Municipal Staff of the Konjic Territorial Defense (ŠTO Konjic), and the Army of the Republic of BiH, the HVO, the Croat Armed Forces (HOS), the Sabotage-Reconnaissance Detachment DIO-A-004 also known as Akrepi, operating within the ŠTO Konjic, members of the Konjic Public Security Station (SJB), Hadžići Territorial Defense and the Hadžići Public Security Station, aimed against the Serb civilian population of the Konjic municipality, specifically the town of Konjic and the surrounding villages of Bradina, Cerići, Zukići, Brđani, Džepi, Zagorice, Hum, Blace, Nevizdraci, Donje Selo, Vrdolje, Živanja, Sitnik, Bjelovčina, Zabrđani, Bijela, and other neighboring villages in the territory of Konjic municipality, knowing of the attack and that his actions formed a part of the attack, Agan Ramić, as a member of the Municipal Staff of the Territorial Defense, or the Army of the Republic of BiH, committed and aided and abetted in the commission of the persecution of the Serb civilian population on political, national, ethnic, cultural and religious grounds in the territory under the control of ŠTO Konjic or the Army of the Republic of BiH, the HVO, the Croat Armed Forces (HOS), the Sabotage-Reconnaissance Detachment DIO-A-004 also known as Akrepi, operating within the ŠTO Konjic, members of the Konjic Public Security Station (SJB), in violation of the rules of international law, by way of torture, committed for the purpose of inflicting great suffering or serious bodily or mental injury or health deterioration.
Therefore, the accused Agan Ramić was charged with the criminal offense of Crimes against Humanity, with the underlying crime of persecution, regarding a criminal act committed to the detriment of the injured party Siniša Živak in the village of Brđani, Municipality of Konjic. Based on the adduced evidence, the Panel was not able to find beyond a reasonable doubt that the accused Agan Ramić undertook the act against the injured party Siniša Živak in the manner described by the Prosecution.
After the judgment was publicly pronounced, the Panel provided a brief outline of the reasons it was guided by in delivering the judgment. The parties and defense counsel were advised of their right to appeal.
