The Court of Bosnia and Herzegovina handed down and publicly announced, on 30 September 2021, the first instance judgment in the case of Cvijan Tomanić finding the accused Cvijan Tomanić guilty of commission of the criminal offense of Crimes against Humanity under Article 172(1) h) in connection with Subparagraphs a) and k) of the CC BiH, all as tread with Article 29 and Article 180(1) of the Criminal Code of Bosnia and Herzegovina. The Court sentenced the accused Cvijan Tomanić to imprisonment for a term of seven (7) years.
The accused was found guilty because, during the period between April 1992 and at least the end of 1992 in the Municipality of Zvornik, within a widespread and systematic attack of the Army of Republika Srpska directed against the non-Serb civilian population in the territory of the Zvornik municipality, as a member of the Army of Republika Srpska (VRS), VP7469 the Zvornik Brigade, being aware of such an attack and knowing that his acts formed a part of the attack, the accused Cvijan Tomanić participated in the persecution of the Bosniak civilian population on national and ethnic grounds in connection with murder and other inhuman acts of similar nature, committed with the intent to inflict severe suffering or serious physical or mental injury or damage to health.
