Trial Judgment pronounced in Ivan Antunović et al.

On 14 May 2023 the Court of Bosnia and Herzegovina delivered a Trial Judgment in the case of Ivan Antunović et al. (S1 2 K 032139 20 K), which found the accused Ivan Antunović, Borislav Kovačević, Mario Vuletić and Haris Hodžić guilty that by the acts described in the convicting part of the Judgment they committed the offenses as follows:

  • the accused Ivan Antunović, as the person who organized and led a group for organized crime – the criminal offense of Organized Crime under Article 250(3) CCBiH, as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) CCBiH,
  • the accused Borislav Kovačević, Mario Vuletić and Haris Hodžić, as members of the group for organized crime, the criminal offense of Organized Crime under Article 250(2) CCBiH, as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) of the Code.

 

The Court imposed on the accused the following sentences of imprisonment:

 

  • the accused Ivan Antunović, as the person who organized and led the group for organized crime, a sentence of fourteen (14) years of imprisonment, with the time he spent in pre-trial custody, specifically from 10 March 2020 to 23 September 2020 and from 28 October 2020 to 5 January 2021, being credited towards his sentence of imprisonment. The accused was also fined with 100,000.00 BAM;
  • the accused Borislav Kovačević, as a member of the group for organized crime, a sentence of six (6) years of imprisonment, with the time he spent in pre-trial custody, specifically from 10 March 2020 to 4 September 2020, being credited towards his sentence of imprisonment.
  • the accused Mario Vuletić, as a member of the group for organized crime, a sentence of seven (7) years of imprisonment, with the time he spent in pre-trial custody, specifically from 14 February 2019 to 13 March 2019, being credited towards his sentence of imprisonment.
  • the accused Haris Hodžić, as a member of the group for organized crime, a sentence of seven (7) years of imprisonment, with the time he spent in pre-trial custody, specifically from 10 March 2020 to 10 April 2020, being credited towards his sentence of imprisonment.

 

At the same time, the ill-gotten gain shall be confiscated from the accused as follows:

 

  • from the accused Ivan Antunović - 230,305.00 EUR, 69,830.00 BAM and 55,780.00 KN;
  • from the accused Borislav Kovačević - 00 EUR and 600.00 KM;
  • from the accused Mario Vuletić - 112,800.00 EUR;
  • from the accused Haris Hodžić - 213,000.00 EUR.

Pursuant to Article 284 c) of the CPC BiH, the Court acquitted the accused Ivan Antunović, Borislav Kovačević and Nikola Bošković of the charges for the commission of certain criminal offenses under certain sections of the acquitting part of the judgment’s operative part.

 

Under the same judgment, pursuant to Article 283(1) e) of the CPC BIH, the Court dismissed the charges against the accused Ivan Antunović, Borislav Kovačević and Nikola Bošković in relation to certain sections in the dismissing part of the judgment’s operative part related to the criminal offense of Organized Crime under Article 250(2) and (3) of the CC BiH, in connection with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) of the CC BiH.  

 

An appeal from the referenced judgment may be filed with the Court’s Appellate Division within 15 days after the receipt of a written copy of the judgment.
