On 20 October 2022 the Court of Bosnia and Herzegovina pronounced a Trial Judgment in the case of Ratko Đurković (S1 1 K 036818 21 Kri) acquitting the accused Ratko Đurković of all charges pursuant to Article 284c) CPC BiH, for it was not proven that by the acts described in the operative part of the Judgment he committed the criminal offense of Crimes against Humanity under Article 172(1)h) as read with Subparagraphs a) and d) of the Criminal Coe of Bosnia and Herzegovina, in conjunction with the criminal offense of War Crimes against Civilians under Article 173(1)f) and the criminal offense of War Crimes against Prisoners of War under Article 175a), all in conjunction with Article 180(2) CC BiH.
The accused is acquitted of the charges that during the period from early April 1992 to late October 1992, within a widespread and systematic attack by military, police and paramilitary forces of Republika Srpska, which targeted the Bosniak civilian population in the territory of Ugljevik municipality, together with the accused N.R., Commander of the First Majevica Brigade of the Republika Srpska Army (VRS), concerning whom proceedings were separated by Court of BiH Decision dated 30 April 2021, knowing of the attack and that his actions form a part thereof, and during the war in BiH between the Army of Republika Srpska and the Army of the Republic of BiH, the accused Ratko Đurković, also performing the duty of de iure and de facto Commander of the First Battalion of the First Majevica Brigade of VRS, in violation of the rules of international humanitarian law under Article 52(1) of the Protocol Additional to the Geneva Conventions of 12 August 1949,. and Relating to the Protection of Victims of International Armed Conflicts (Protocol I) and Article 3(1)a), as well as Articles 12, 13 and 14 of III Geneva Convention on Prisoners of War of 12 August 1949, took part in the persecution of the Bosniak civilian population in the territory of Ugljevik municipality on ethnic and religious grounds, in the manner that he led the attack on the village of Tursunovo brdo, Municipality of Ugljevik, populated by Bosniaks, in which unidentified members of the units under his de facto and effective control killed Bosniak civilians, forcibly relocated non-Serb civilian population and unjustifiably destroyed the property of non-Serb population on a large scale, and killed prisoners of war.
