Trial Judgment pronounced in Sabahudin Kajdić case

On 19 January 2022 the Court of Bosnia and Herzegovina delivered and pronounced a Trial Judgment finding the accused Sabahudin Kajdić guilty of the criminal offense of Crimes against Humanity under Article 172(1)h) as read with Subparagraphs a), i) and k) of the Criminal Code of Bosnia and Herzegovina, all in conjunction with Articles 29 and 180(1) of the Code. The Court sentenced him to 12 (twelve) years of imprisonment.

The accused Sabahudin Kajdić has been found guilty that, within a widespread and systematic attack of the army and the police of the Serb Republic of BiH, subsequently Republika Srpska, on the non-Serb civilian population in the territory of Prijedor municipality, between June 1992 and late August 1992, knowing of the attack and that his actions formed a part of the attack, in his capacity as a member of the 3rd Company, 1st Battalion, 43rd Prijedor Motorized Brigade of the Army of Republika Srpska, in violation of the rules of international humanitarian law, he committed persecution of Bosniak civilian population on ethnic and religious grounds by way of killing, enforced disappearance and other inhumane acts committed with the aim of inflicting great suffering or serious physical or mental injury or health deterioration, in the manner described in the operative part of the Judgment.

 

Any appeal from this Judgment may be filed with the Appellate Division Panel of the Court of BiH within 15 (fifteen) days of the day of its reception.
