The Court of Bosnia and Herzegovina issued a Decision on 21 December 2021, rejecting the Indictment against the suspect Milenko Stanić for the criminal offense of Crimes against Humanity under Article 172(1)(h) of the Criminal Code of Bosnia and Herzegovina, as read with Article 180(1) thereof.
Prior to making a decision on the Indictment, the Court has sent a letter to the BiH Prosecutor's Office asking it to consolidate the Indictment, inter alia also because of the fact that the suspect was not presented with all incriminating allegations and acts mentioned in the Indictment, after which it found that the BiH Prosecutor's Office has failed to do as requested in the letter.
The Indictment charges the accused Milenko Stanić with a significantly larger criminal quantity than the one presented to him during his investigative interview, which makes the suspect interrogation record deficient. Therefore, since in accordance with Article 225(6) CPC BiH the Prosecutor's Office could not issue an indictment because it had failed to question the suspect about all the incriminations he has been charged with, which it was requested to do on 19 November 2021, the Court has ultimately proceeded in line with Article 148(3) CPC BiH and decided to dismiss the indictment.
