In deciding on a motion filed by the Prosecutor’s Office to order the suspect Jelenko Knežević in custody, the Court of Bosnia and Herzegovina issued, on 6 April 2022, a decision partly granting the Prosecution’s motion, and ordered the suspect Jelenko Knežević in custody. Pursuant to the referenced decision, custody can last no longer than one month, running from the arrest day, that is, until 5 May 2022 or a new decision of the Court. The suspect is ordered into custody on the grounds of the existing particular custody reasons set forth in Article 132(1) a) and b) of the Criminal Procedure Code of Bosnia and Herzegovina (CPC BiH), namely due to a risk of flight, fear that the suspect will destroy, conceal, alter or forge evidence and clues relevant to the criminal proceedings, and that he will exert influence on the witnesses, accomplices or concealers.
The Court dismissed as ill-founded the Prosecution’s proposal to order the suspect in custody on the custody grounds set forth in Article 132(1) c) of the CPC BiH, that is, due to a fear that the suspect will repeat the criminal offense or complete the attempted criminal offense.
Bojan Cvijetić and others have been under suspicion that they committed the criminal offense of Organized Crime under Article 250(2) and (3) of the Criminal Code of Bosnia and Herzegovina (CC BiH), in connection with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) of the CC BiH.
