In the case of Mustafa Vrabac (S1 2K 044784 23 Krn 3), ruling on the Prosecutor’s Motion of 11 January 2023 to order custody of the suspect Mustafa Vrabac, having held a hearing, on 12 January 2023 the Court of Bosnia and Herzegovina issued a Decision granting the Prosecutor’s Motion, and ordered the suspect Mustafa Vrabac in custody, which under the Decision may last for a maximum of one (1) month, running from the day of arrest, which means from 9 January 2023 to 9 February 2023 or pending another Decision of the Court, on account of the existence of the particular ground of custody referred to in Article 132(1)b) of the CPC BiH.
The suspect is ordered in custody on account of the existence of grounded suspicion that he committed the criminal offense of Accepting Reward or Other Forms of Benefit for Trading in Influence under Article 219(1) of the Criminal Code of Bosnia and Herzegovina (CC BiH). Having determined the existence of grounded suspicion as a general ground of custody, the Court has examined whether the Prosecutor’s Motion regarding the existence of the particular ground for custody referred to in Article 132(1)b) CPC BiH was well-founded, and found it to be entirely well-founded, so that it ultimately ordered custody of the suspect Mustafa Vrabac on the particular custody ground referred to in Article 132(1)b) CPC BiH, which is the existence of particular circumstances indicating that, if released, the suspect might hinder the criminal proceeding by interfering with the witnesses or possible accomplices, and that he might destroy, conceal, alter or forge the evidence and traces important for the criminal proceeding.
An appeal from this Decision shall not stay its execution.
