In deciding on a motion filed by the Prosecutor’s Office of BiH to order the suspect Nermin Balić (the case of Darko Jovanović et al.) in custody, the Court of Bosnia and Herzegovina issued, on 28 September 2021, a decision granting the motion of the Prosecutor’s Office of BiH and ordering the suspect Nermin Balić in custody. Pursuant to the referenced decision, custody can last no longer than one month running from the arrest day, that is, until 25 October 2021 or a new Court’s decision. Custody was ordered on the grounds set forth in Article 132(12) a), b) and c) of the Criminal Procedure Code of Bosnia and Herzegovina, that is, due to a risk of flight, the risk that the suspect will destroy, conceal, alter or forge the evidence and traces relevant to the criminal proceedings, exert influence on the witnesses, accomplices or concealers, and due to a risk that he will repeat the criminal offense or complete the attempted criminal offense.
Nermin Balić has been suspected of commission of the criminal offense of Organized Crime under Article 250 of the Criminal Code of Bosnia and Herzegovina (CC BiH), in connection with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) of the CC BiH.
