On 12 November 2021 the Appellate Division Panel of the Court of Bosnia and Herzegovina sent out an Appeals Judgment of 27 October 2021 in the case of Simo Stupar, dismissing as ill-founded the appeal filed by defense counsel for the accused Simo Stupar against the acquitting part of the Trial Judgment of the Court of BiH No. S1 1 K 030715 18 Kri dated 11 May 2021, so the Judgment was upheld in that part.

On 11 May 2021 the Trial Panel of the Court of BiH delivered the Trial Judgment in the case of Simo Stupar et al. finding the accused Simo Stupar guilty of the criminal offense of Crimes against Humanity under Article 172(1)h) - persecution, as read with Subparagraph a) - depriving another person of his life, Subparagraph k) - other inhumane acts of a similar character, and Subparagraph i) - enforced disappearance, all in conjunction with Articles 29 and 180(1) CC BiH. The Court sentenced him to 12 (twelve) years of imprisonment.

The accused Simo Stupar was found guilty that, in the framework of a widespread and systematic attack directed against the civilian population in the territory of Vlasenica municipality, knowing of the attack and that his acts form a part of the attack, he took part in the persecution of the Bosniak civilian population on ethnic and religious grounds, in relation to murder, enforced disappearance and other inhumane acts of a similar character, committed with the intent to inflict great suffering or serious physical or mental injury or violation of health.

The accused Simo Stupar is acquitted of the charges that by the acts described in Section II of the Operative Part of the Judgment he committed the criminal offense of Crimes against Humanity under Article 172(1)h) as read with Subparagraphs e) and k) CC BiH, all in conjunction with Articles 29 and 180(1) CC BiH.  

The Court dismissed the charges that by the acts described in Section III of the Operative Part of the Judgment the accused Simo Stupar committed the criminal offense of Crimes against Humanity under Article 172(1)h) as read with Subparagraphs a), e) and k) CC BiH, as read with Article 29 CC BiH, all in conjunction with Article 180(1) CC BiH.
