On 7 November 2023 the Court of Bosnia and Herzegovina delivered an Appeals Judgment in the case of Boris Kordić et al. (S1 2 K 022492 22 Kž) finding the accused Boris Kordić and Josip Kvesić, under Counts 1, 2 and 3 of the Indictment, guilty that, in their capacity as official persons at the Service for Foreigners Affairs of the BiH Ministry of Security, Field Office Mostar, they committed the criminal offense of Organized Crime under Article 250 of the Criminal Code of BiH (CC BiH) as read with the criminal offense of Abuse of Office or Official Authority under Article 220 CC BiH and the criminal offense of Extortion under Article 295 of the Criminal Code of the BiH Federation (CC FBiH). The Court sentenced the principal accused Boris Kordić to a compound sentence of 12 (twelve) years and 6 (six) months of imprisonment.
By the same Judgment, the Court sentenced the second-accused Josip Kvesić to a compound sentence of 8 (eight) years and 6 (six) months of imprisonment.
The ill-gotten gain in the amount of 60,000.00 BAM shall be confiscated from the accused Boris Kordić and Josip Kvesić, which they shall pay jointly towards the BiH budget.
Having delivered the Appeals Judgment, on 27 November 2023 the Court issued a Decision extending the travel ban imposed on the accused Boris Kordić and Josip Kvesić, as well as the measure of seizure of travel documents, including a ban on issuing new ones, as well as the ban on the use of ID to cross the BiH state border. These measures will remain in effect until the accused are committed to serve their prison sentences.
The accused Boris Kordić and Josip Kvesić have been found guilty that, in their capacity as official persons in the institutions of BiH, between October 2012 and March 2014, operating within a group for organized crime, using their official positions and authorities, they extorted money from foreign citizens in the manner that they issued unlawful documents and took unlawful official acts, all in order to force foreign citizens staying in the territory of Bosnia and Herzegovina, representative offices of foreign non-governmental organizations registered in the territory of Bosnia and Herzegovina, and other legal entities run by foreign citizens in the territory of Bosnia and Herzegovina to take steps to the detriment of their own and other people’s property.
