The Appellate Division Panel of the Court of Bosnia and Herzegovina has sent out an Appeals Judgment in the case of Miladin Trifunović (S1 1 K 031562 19 Krž), dismissing as ill-founded the appeal filed by the Prosecutor's Office of Bosnia and Herzegovina, so the Trial Judgment of the Court of Bosnia and Herzegovina of 13 December 2023 is upheld.
Pursuant to Article 284, Subparagraph c), of the CPC BiH, the Trial Judgment of the Court of BiH, No. S1 1 K 031562 19 Kri of 13 December 2023, acquitted the accused Miladin Trifunović of the charges that by the acts described in the Judgment he committed the criminal offense of Crimes against Humanity under Article 172(1), Subparagraphs a) and k), as read with Article 180(1), Article 30, and Article 31, of the CC BiH. The Indictment charged the accused Miladin Trifunović that from early July to 16 December 1992, during the armed conflict between the Army of Republika Srpska (VRS) and the Army of the Republic of Bosnia and Herzegovina (ARBiH), he acted in violation of the rules of international law by breaching the provisions set forth in the Geneva Convention relative to the Protection of Civilian Persons in Time of War, in the framework of a widespread and systematic attack launched by the VRS on the civilian Muslim population of the Vogošća and Ilijaš municipalities, knowing of the attack and that his actions formed a part thereof, as the Commander of the Vogošća (Crnovrška) Brigade of the VRS, with the aim of inflicting great suffering and injury to bodily integrity of civilian persons, planned, ordered, instigated and aided and abetted in the widespread and systematic attack on the civilian Muslim population of the Vogošća and Ilijaš municipalities on political, national, ethnic, cultural and religious grounds, by way of murder and inhumane acts, by which acts he would have ultimately committed the criminal offense he was charged with.
