The Panel of the Appellate Division of the Court of Bosnia and Herzegovina sent out, on 30 October 2024, a second instance judgment in the case of Selmo Cikotić dismissing as ill-founded the appeal filed by the Prosecutor’s Office of Bosnia and Herzegovina and the appeal of the accused’s defense counsel, and upholding the Trial Judgment of the Court of Bosnia and Herzegovina of 5 December 2023.
Under the Trial Judgment, the accused Selmo Cikotić was found guilty because as an official person within the institutions of Bosnia and Herzegovina, in the capacity of the defense minister of Bosnia and Herzegovina, by abusing office and official authority, he committed a continued criminal offense of Abuse of office and Official Authority under Article 220(3) of the Criminal Code of BiH (CC BiH) in connection with Paragraph 1 of the same Article, all as read with Article 54 of the same Code, which is why the Court sentenced him to 3 (three) years in prison.
No appeal lies from the Trial Judgment.
