Third-Instance Judgment sent out in the case of Adem Kostjerevac

The Appellate Division Panel of the Court of Bosnia and Herzegovina on 29 April 2022 delivered and on 29 June 2022 sent out a Third-Instance Judgment in the case of Adem Kostjerevac, dismissing as ill-founded the appeals from the Judgment of the Court of Bosnia and Herzegovina, filed by both the Prosecution and defense counsel, while upholding the Second-Instance Judgment of the Court of Bosnia and Herzegovina No. S1 1 K 018560 21 Kžk of 21 December 2022, which, on completion of the trial, found the accused Adem Kostjerevac guilty of the criminal offense of War Crimes against Civilians under Article 142(1) CC SFRY. The Appellate Division Panel sentenced him to seven (7) years of imprisonment.

By its First-Instance Judgment No. S1 1 K 018560 20 Kri of 12 March 2021 the Trial Court dismissed the charges that the accused Adem Kostjerevac committed the criminal offense of War Crimes against Civilians under Article 142(1) CC SFRY.

 

The accused Adem Kostjerevac is found guilty that during the war and the armed conflict in Bosnia and Herzegovina, as a member of the Military Police of the 1st Muslim Brigade Zvornik, Army of BiH, from 18 September 1992 to 4 October 1992, in the territory of Zvornik municipality, he proceeded in violation of the rules of international humanitarian law and Article 3(1), Subparagraphs a) and c), and Article 27 of the Geneva Convention relative to the Protection of Civilian Persons in Time of War dated 12 August 1949, by forcing a civilian to sexual intercourse.
